INDIANAPOLIS — A Malaysian man who allegedly illegally obtained Viagra through a website that falsely claims that he had a prescription for it by using the Internet to obtain cheaper drugs from online pharmacies is now facing legal action.
In February, the U. S. Attorney's office in Philadelphia said he is investigating claims that he was in possession of counterfeit erectile dysfunction medicines.
The case is related to a lawsuit filed by the man's wife, who allegedly bought a bottle of Viagra from a pharmacy in Malaysia.
She was diagnosed with the condition in 2006, and had been taking the drug for five years, the suit alleges, before her husband began taking it.
Viagra was originally developed as a treatment for erectile dysfunction in the 1950s. The drug works by increasing blood flow to the penis, which helps men get an erection.
However, several studies showed that taking Viagra could increase the risk of developing prostate cancer.
A court in Singapore last month found that the drug was sold illegally online.
The suit alleges that the online pharmacy, which is based in Malaysia, illegally marketed the drug for erectile dysfunction and other reasons.
In a complaint filed in September, the lawyer for the man's wife, Lu Mei, said: "These cases have created confusion for the public and the law enforcement community."
"The law enforcement community in the region is concerned that these online pharmacies are selling counterfeit products," the lawyer added.
The man's lawyer said the case is related to the online pharmacy's use of the Internet to purchase cheaper drugs.
He said that he was arrested in the Philippines and has been charged with a violation of the Drugs and Cosmetics Act.
"It is important to note that the FDA regulates the sale and distribution of drugs online, and it is a violation of the law that these drugs can only be obtained from licensed online pharmacies," the lawyer added.
The lawyer said he was being investigated for selling the fake drugs and had received a warning letter from the FDA about the illegal activity.
The lawyer said he had received a phone call from a woman who was taking Viagra to buy some erectile dysfunction pills. The woman was taking Viagra on a daily basis, he said.
The man's lawyer, who is representing the plaintiff in the case, said: "I can assure you that this is the case."
He added that the online pharmacy did not sell the fake drugs. He said that the online pharmacy had been selling the fake drugs for six months.
The lawyer said that a warning letter was sent by the FDA to the website to highlight the online pharmacy's illegal conduct.
The lawyer said that the online pharmacy did not disclose to the FDA the information about its illegal practices.
"We are not aware of any information that the drug was sold online to the public, or that the website had a prescription from a doctor," the lawyer said.
He said that the online pharmacy's website was operated by a group of online criminals.
"We are not aware of any reports or information about the online pharmacy selling counterfeit products," the lawyer added.
The lawyer said that the website did not disclose the fact that the drug was being used to treat erectile dysfunction.
"There were no claims that the website was selling counterfeit products, or that the website was selling drugs that were not approved for sale on the Internet," he added.
He said that he has filed multiple complaints against the online pharmacy for selling fake drugs.
"I have filed multiple complaints against this online pharmacy for selling the fake drugs. We have received reports of numerous complaints from men suffering from erectile dysfunction," the lawyer said.
